Zu beachten ist seit dem Urteil des Bundesarbeitsgerichts (BAG, Az.: 9 AZR 541\/15) vom 19. Februar 2019, dass der Arbeitnehmer nicht mehr alleine daf\u00fcr verantwortlich ist, seine Urlaubstage zu konsumieren.<\/p>\n\n\n\n
Sofern der Verfall nicht \u201eklar und rechtzeitig\u201c angek\u00fcndigt wurde (am besten schriftlich) und die Gelegenheit gegeben wird, den Urlaub zu konsumieren, verfallen die vorhandenen Urlaubstage nicht mehr.<\/p>\n\n\n\n
Was \u201erechtzeitig\u201c bedeutet, wurde offengelassen und wird wohl in Zukunft den Gerichten Arbeit machen.<\/p>\n\n\n\n
Am Ende des Jahres erlischt der Urlaubsanspruch eines Arbeitnehmers nur dann, wenn der Arbeitgeber ihn \u00fcber Urlaubsanspruch\/Verfallfristen belehrt hat und der Arbeitnehmer den Urlaub dennoch aus freien St\u00fccken nicht genommen hat.<\/p>\n\n\n\n
Praktisch bedeutet die neue Regelung also, dass die Verantwortung beim Saloninhaber liegt\u2026<\/p>\n\n\n\n
